Garden Day is a community movement that was created by the Candide app. Candide does not profit from Garden Day, but has created the celebration as part of its mission to engage more people with gardens and gardening, to bring garden enthusiasts together to share and learn and to highlight the many benefits of spending time in the garden.

Candide Privacy Policy

This privacy policy applies to all our platforms. When we talk about our “Platforms” we refer to all our websites, mobile sites, mobile apps, social media platforms or any other technology or mechanism you may use to interact with us.

This privacy policy describes how we process personal information we collect and/or receive from you.

Personal information we collect and receive

“Personal information” is information that identifies you as an individual or relates to an identifiable individual, such as your name, postal address, telephone number, email address, and payment details.

We collect and receive personal information about you in the following ways:

Personal information you give us

  • This includes any personal information that you provide to us directly:
  • by filling in forms on our Platforms;
  • when you enter a competition, promotion or complete a survey;
  • by posting comments or content on our Platforms;
  • when you purchase our products or services;
  • when you contact us or we contact you and you provide information directly to us.

Personal information we collect or receive when you use our platforms

We collect personal information when you use our Platforms by using cookies, web beacons and other technologies. Depending on how you access and use our Platforms, we may receive:

  • log-in information;
  • information we infer about you based on your interaction with Platforms, products and services;
  • device information (for example the type of device you’re using, how you access platforms, your browser or operating system and your Internet Protocol (“IP”) address);
  • location information.

Personal information from third-party sources

We may receive additional personal information about you that is publicly or commercially available and combine that with the personal information we have collected or received about you in other ways.

How we use the personal information we collect and receive

We use the personal information we collect and receive for the following general purposes:

  • to provide you with information, products or services you request from us, and to be effective and relevant in the services we provide you. We will engage in these activities to manage our contractual relationship with you and/or to comply with a legal obligation.
  • to communicate with you. We will engage in this activity with your consent or where we have a legitimate interest.
  • to provide effective advertising. Many of our Platforms are supported by advertising. We want to enhance our users’ experience by serving advertising that may be useful to them. Some of the ways we do this are by:
  • showing you advertising based on your online activities, such as the websites and apps you use or the content you viewed, as well as data we have collected about you, data that you have provided to us, or data that we have received from third-party sources;
  • limiting the number of times you see the same advertising; and
  • measuring the effectiveness of the advertising we serve. We engage in these activities to manage our contractual relationship with you, to comply with a legal obligation, and/or because we have a legitimate interest.

We also use and disclose your personal information as necessary or appropriate, especially where we have a legal obligation or legitimate interest to do so:

  • to comply with applicable laws and regulations. This can include laws outside your country of residence.
  • to cooperate with public and government authorities. This can include responding to a request or providing information that we believe is important to authorities, both within and outside your country of residence.
  • to cooperate with law enforcement;
  • for other legal reasons, such as enforcing our terms and conditions, and protecting our rights, privacy, safety or property and/or that of our affiliates, you or others; and
  • in connection with a sale or business transaction. We have a legitimate interest in disclosing or transferring your personal information to a third party in the event of any reorganisation, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy).

How we share the personal information we collect and receive

We don’t sell your personal information to third parties for their marketing purposes.

We may share personal information with:

  • our affiliates, in other words, other companies in our group;
  • our business partners. We may share non-personally identifiable information with select business partners;
  • other parties in response to legal process or when necessary to conduct or protect our legal rights;
  • companies that provide services to us. Companies that provide services to us or act on our behalf may have access to information about you. These companies are limited in their ability to use information they receive in the course of providing services to us or you;
  • third-parties where you provide consent. In some cases, third-parties (often advertisers), may wish to obtain information about you in order to promote their products to you, or for whatever other reason. We may share information with third-parties, where you provide consent in the form of explicit opt-in and we provide you with a clear description of what data would be shared with the third-party. Remember that once you have opted in to allow us to send your information to the third-party, we cannot control what they do with your data; therefore, be sure to investigate their privacy policies before providing permission for us to share your information.

Monitoring of communications

We may monitor and record our communications with you, including e-mails. Information which we collect may then be used for training purposes, quality assurance, to record details about the products and services you use or ask us about, and in order to meet our legal and regulatory obligations generally.

Your choices

You have the right to ask us not to contact you for marketing purposes. You can exercise this right at any time by using any of the various “opt-out” options that we will always provide to you when we communicate with you. We will try to comply with your requests as soon as reasonably practicable. Please note that we won’t send you marketing messages if you tell us not to but we will still need to send you service-related messages.

You can opt-out of getting marketing messages in the following ways:

  • when we call you as part of a telemarketing campaign, you can tell us if you don’t want to receive any more marketing calls;
  • when we email you, you can use the link in it to opt-out of marketing emails;
  • when we text you, you can text back to tell us to stop further SMS marketing;
  • change the cookie settings we hold for you on our website so you don’t receive targeted advertising online.

We want to make sure that any data we hold about you is up to date. If you think your personal information is inaccurate, you can ask us to correct or remove it.

You have the right to know what personal information we hold about you. If you’d like a copy of some or all of your personal information, write to us at [email protected] and we will be happy to provide you with a copy of the personal data we store about you in electronic format. We will respond to your request consistent with applicable law.

Please note that we may need to retain certain personal information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion.

Depending on how you set up your marketing preferences, we may share information about how you’ve used our website with our advertisers and other companies who offer their services on our Platforms.

Our cookies collect information about your usage of our Platforms including some anonymised account information which you have already given us, such as your age range. We may use cookies to show you relevant adverts based upon this information. This is called Interest Based Advertising. You can change your cookie preferences, or opt-out entirely at any time.

Our commitment to security

We seek to employ a number of reasonable organisational, technical and administrative safeguards intended to mitigate the risk of unauthorized access or disclosure of your personal information. We will do our best to protect your personal information and we will use up to date technology that will help us to do this. We will at all times comply with our obligation under law.

Retention period

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law.

The criteria used to determine our retention periods include:

  • the length of time we have an ongoing relationship with you and provide our services to you (for example, for as long as you have an account with us or keep using the services);
  • whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them);
  • whether retention is advisable in light of our legal position (such as in regard to applicable statues of limitations, litigation or regulatory investigations).

Links to other websites

The Platforms, our websites or social media platforms may contain links to and from websites, mobile applications or services of third parties, advertisers or affiliates. Please note that we are not responsible for the privacy practices of such other parties and advise you to read the privacy statements of each website you visit which collects personal information. The inclusion of a link to third party services or products does not imply endorsement of the linked site or service by us or our affiliates.

Use of services by minors

Our services are not directed to individuals under the age of thirteen (13) and we do not knowingly collect personal information from individuals under 13.

International users

We are based in and operate from the UK, and, regardless of where you use or access our website, products, or services, your personal information may be transferred to and maintained on servers located in the UK (or elsewhere in the world). Please note that any personal information we obtain about you will be stored in accordance with UK privacy laws, regulations and standards, which may not be equivalent to the laws in your country of residence. By providing your personal information to us or by using our websites you consent to the processing and transfer of your personal information to and in the UK (or elsewhere in the world). We might transfer your personal information to places outside the UK or European Economic Area (“EEA”) and store it there, where our suppliers might process it.

For transfers from the EEA to countries not considered adequate by the European Commission (the full list of such countries are available here), we have put in place adequate measures, such as standard contractual clauses adopted by the European Commission, to protect your personal information. You may obtain a copy of these measures by contacting us at [email protected]

Third party payment service

We may use a third-party payment service to process payments made through our services. If you wish to make a payment through the services, your personal information will be collected by such third party and not by us, and will be subject to the third party’s privacy policy, rather than this privacy policy. We have no control over, and are not responsible for, this third party’s collection, use and disclosure of your personal information.

Changes to this privacy policy

We may update this privacy policy from time to time. Any changes we may make to our privacy policy will be posted on our website. Your use of the services following these changes means that you accept the revised privacy policy.
